Terms of Service for Third Parties

These Terms of Service for Third Parties ("Third-Party Terms") govern participation in the Samsagram Referral Program by any person or entity that is not using Samsagram as a Creator or Subscriber ("Referrer," "you"). Samsagram does not offer API access, developer integrations, or any technical connection to the Platform for third parties — the Referral Program is the only way a third party may participate in or benefit from Samsagram outside of being a Creator or Subscriber.

These Third-Party Terms supplement, and do not replace, Samsagram's general Terms of Service. Where the two conflict as applied to a Referrer, these Third-Party Terms control.

• You must be at least 18 years old and hold a valid Samsagram account to enroll in the Referral Program.
• Enrollment is subject to Samsagram's approval and may be declined or revoked at Samsagram's discretion, including for applicants in restricted jurisdictions or with a prior history of policy violations.
• Each Referrer receives a unique referral link or code to share; referral links may not be issued to, or used on behalf of, another person or entity without Samsagram's written consent.

• Once all three qualifying steps are completed, the Referrer earns a reward equal to 50% of the referred user's first subscription payment
• The reward is calculated on the amount Samsagram actually collects from that first payment, before any taxes, processor fees, or applicable deductions
• Rewards are calculated only on legitimate, non-reversed, non-fraudulent transactions
• A referral is attributed to the Referrer whose link or code was used at registration; Samsagram's attribution records are final
• Samsagram may update the 50% rate or the qualifying steps for future referrals with reasonable notice; changes do not apply retroactively to referrals that already qualified

A referral becomes eligible for a reward only once the referred user has (1) successfully registered using your referral link or code, (2) completed setup of their bot on the Samsagram platform, and (3) paid for an active subscription plan for that bot. Registration alone, or setup without a paid subscription, does not trigger a reward.

You may share your referral link through your own content, channels, or communications, provided you do not:

• Refer yourself, an account you control, or an account created solely to generate referral rewards
• Spam, cold-message, or solicit unrelated Telegram users, email lists, or social accounts with your referral link
• Make false or misleading claims about Samsagram, its pricing, features, or reliability in order to drive referrals
• Bid on Samsagram's brand name in paid search advertising, or use Samsagram's name in a domain name, without written permission
• Use your referral link to promote a channel, Creator, or use case that would itself violate Samsagram's general Terms of Service, including the prohibition on illegal activity
• Represent yourself as an employee, official partner, or agent of Samsagram beyond your status as a Referral Program participant

• The 50% reward is paid out after the referred user's first subscription payment has cleared any refund or chargeback window.
• The reward applies to the first qualifying subscription payment only, unless the Referral Program's published terms state otherwise for a specific promotion.
• Samsagram may deduct, reverse, or withhold a referral reward tied to a transaction that is later refunded, charged back, or found to violate Samsagram's general Terms of Service.
• Samsagram may require identity or tax information before releasing a payout where required by law.

Samsagram's name and logo may be used in referral promotion only in the form provided by Samsagram, and only to accurately describe your participation in the Referral Program (for example, "I use Samsagram" or "Get started with Samsagram"). You may not alter Samsagram's logo, imply an endorsement or partnership beyond the Referral Program, or make commitments on Samsagram's behalf regarding pricing, features, uptime, or support.

You agree to indemnify and hold Samsagram harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your promotional activity, your violation of these Third-Party Terms, or your violation of applicable law.

Your participation in the Referral Program continues until you or Samsagram end it. Samsagram may suspend or terminate your Referral Program participation at any time, with or without notice, for a violation of these Third-Party Terms or Samsagram's general Terms of Service. Upon termination, any pending rewards tied to violating conduct may be forfeited; legitimately earned, undisputed rewards will still be paid.

These Third-Party Terms are governed by the laws of Kenya, without regard to conflict-of-law principles, unless otherwise required by applicable local law.
